They are plaing to pass a bill where a artist of any kind, even writers like me, need to buy a copyright to protect what's mine. Big Al on Youtube is the one to bring my atention to this grave matter.

The guy in that video didn't seem very knowledgeable or up to speed. I hardly think BigAL should be a trusted source for information.

[editted comment below:]
If you listen to the Video Response to BigAl, you'll hear the other guy shoot down bigAL's rant being a rumor- the bill is "phony baloney"

And BigHal2k6 wrote back an hour ago saying "God i feel like such a jackass."

Yeah- The rumors above about the bill taking away your ownership is false. You are still always the copyright holder. I can't believe BigAl gets that many people watching what he says and take it as word of truth. LOL.
---

This is a US related law. Which has very little weight really in regards to artists in other countries. There are too many 'issues' surrounding the international copyright stuff.

Also this is for "Orphan Works" - which is for owners who cannot be located. But if you can prove that you are the creator and HAVE the original (for artists this shouldn't be a problem physically), you'll be fine.

But here is the bottom line. If you can prove it is yours, you can do so in a court. Key thing is the original.

Now, for writers, to prove that the work is yours... There is an old method for copyright associated to pieces of writing/code. You print a copy of the work. And MAIL it to yourself. DO NOT open the letter/envelopment, and this will prove that your work is yours as dated by the US postal office. Or another method is notarize the work. Once you do this, if a case ever arises that you have to prove that you are the copyright holder, that document is proof. Best to get it notary public to notarized the document.
Remember though, the notary public only prooves that you signed a document and stamps them for that date. They can't verify that you are a copyright holder. But the dating is the important factor in which something is created. If somebody steals your work, and you have no way of proving that you created it before they did, then you're screwed.

Digital artwork, you'll need to do the same thing above.

Some useful links:

http://www.copyright.gov/circs/circ1.html

NOTE: If you were PAID to create something by an EMPLOYER for instance, you are NOT actually the copyright holder. This includes commission work and contributions to a collective work.

Do you have a link to this bill ? The links that you provided are probably outdated. The video might be OLD. That petitioning site is also lame. It has no links to the actual bill in question. You'll end up getting a bunch of people signing something they don't even know why.

Here is something you should read....
http://www.sourcewatch.org/index.php?title=Orphan_works_legislation

The bill you're talking about was in 2006. And has been shot down already. Is there a copy of the new bill out there?

You're scaring alot of people over nothing really. Because the copyright problem has always been the same for years. And the problems surrounding it is always the same. Proof of ownership.

If you're concern about your work, you should secure your copyright or at least have some means to be able to prove that it is yours.

"Orphan Works" are materials that nobody can identify or find the owner for. If the owner surfaces, then it is no longer an orphan work and the copyright laws apply, and you'll just need to prove that you are the owner (which has always been the case.)

If you posted your story on a public forum, and it is dated. That's proof that it is yours already. Since you are the author, and you posted it first, (only the real author can share it for the first time) have the first date stamp. Sharing it on multiple forums or locations further increases your proof that it is yours. If somebody else tries to even steal it, you can challenge that in a court.

If your work gets circulated without your name or somebody else's name. You are in the rights to do what you need to do to shut that down or properly correct the ownership by line.

The big scare in 2006 hype:
http://www.nikondigital.org/dps/dps-v-4-08.htm
(From reading that article, sure It sounds pretty bad. not terribly bad really. NOTE, that the article mentioned by the END OF MARCH 2006. Which means the article was prior to MAY 2006. See the actual proposed bill below.)

Here's what the bill says:
http://thomas.loc.gov/cgi-bin/query/z?c109:H.R.5439:

Which IS NOT as bad as the previous article made it sound. Probably because it got revised, after comments already submitted in 2006.

NOTE it has not been passed yet. Still dated 2006. If it has been enacted as law, it will have a link to the actual bill.

If your work contains say PleasureBonBon. Or has characters that are PleasureBonBon identifiable. The person who tries to use it has to "diligently" proove that he searched for the owner and the source- which also includes the Internet. (Doesn't have to be the copyright registration office.) If the material is furry related and he should have posted to a community to find out if anybody knows who the owner is of the material.

It's safe to say you are covered in your case specifically. Especially if your piece of work can be 'searched' and it comes across various places on the Internet with an author by line.

Secondly, you can say that your "license fee" is some crazy number. So you could in theory, sue the guy who steals it from you for the "license fee".

Actually- I want to say thanks for pointing the above out to me.

Some of the stuff I've been researching on this copyright stuff is actually useful and a few things I didn't know about copyright law....

I know somebody who has to deal with copyright law issues and might find some of this helpful too!

Phew... I'm sorry I scared anyone, Ronald. I'm not exactly always on the ball about details like these, but I am relieved to know my story is safe. I'm deeply sorry if I scared anyone here, but this came across to me as a very scary issue. Thank you so much for putting my mind at ease, Ronald. I owe you a big one for that.

I was kind of scared too listening to that guy bigAL. But he's 19. And the way he came across in the video was very uninformative. It prompted me to do some research- cuz what he said sounded too far fetch. "A bill that takes away your copyright ownership." What is that?

You'll always be the copyright owner that is defined by the copyright law that we are all used to knowing. If you created it and you can prove it is yours, then its yours (unless you got paid to do it for hire).

Which is actually, useful to know.... I was scammed once by an artist who did my cartoon character for me that was MY CREATION. Then later on, he said he still owns copyright, after the fact that I paid him for the negotiated price. And then he decides to charge me an arm and a leg for the copyright release. Basically, I got overcharged. Needless to say, I no longer hire him to do work for me.

How would that apply to "Intellectual Property"?

I didn't think it would effect Bon Bon, seeing how its Italian based.

I've been told that idea about mailing it to yourself Ronald. Very handy I must say.
